Posts: 2 11/09/2009 23:00	Tags : None Without naming names or going into gory details, I've had deposits out with two seperate makers, one for 3-1/2 years and another for 4+. I call, I email, I get stroked and promised but still no rods. These aren't onesy-twosey guys I'm talking about here, they're big name makers and I know for a fact they've delivered orders to customers long past me in the meantime. I run a small business, I take orders, do my work and bill when it's done. If I don't deliver, I don't get paid. What makes these guys so special they can ask for money up front and blow me off for 4 years or so? If I did that, I'd be in jail! And where does it say I have to call them every week and pester them until they finally decide they've had enough and they'll make my rod just to get me off their back? They took my money, they wrote my orders in their sacred Order Book, is there no business ethic among cane rodmakers? I've just sent emails to both, asking for a refund of my deposit. Am I out of line with this? Both makers took my orders with the express understanding that they would be fulfilled promptly, not subject to their usual wait period, now it's 4 years down the road and I have no rods but they have my money.... What do I do? Sue them? Posts: 681 11/10/2009 00:14	Bill I have had the opposite problem. I have done rod work and sold a used rod to someone on the board. It has gone on and on just like your experience. I have argued that when these things happen how can it be wrong to have people send you a PM and find out who these losers are. I keep being reminded that rules say do not say anything bad but if it is private how can that be wrong. I have not solved your problem Bill ,but I know your frustration.

Posts: 841 11/10/2009 02:30	there are builders out there that make good to excellent rods who dont have 5yr waiting lists. they may not be famous but they are honest and hardworking and stand behind their product.perhaps you could find something that would make you happy for half the price and with none of the frustration you describe, if you give them a chance. It`s human nature for someone thats comfortable and assured of a nice living to tend to do things their own way.just like its in a mans nature to strive for comfort and assurance of a nice living by giving extra effort and service to attain these things . which maker you choose of course is up to you,but i would think the hungry fellow will give you the best chance at quick and drama free customer service. The builders ego and unwarranted press works its magic and there you are, behind all the 'cool' customers. The vast majority of $2500+ rods that I have seen are worse than my bottom line $800 rod in fit and finish, let alone integrity of construction, where there is no comparison. Man, am i going to get a raft of crap about this, but i am past caring. Grumpy AJ

And, what delivery were "you" advised? I can't imagine a builder, hypothetically, promising a rod in 6 months when his normal delivery is 2 years? Did you pay more than their ususal deposit? If you were promised an accelerated delivery and paid for that, and you can document it, you might have recourse...I really don't know. Strange that this would happen with two different builders!? I would agree with AJ that the perception that when you spend big bucks you will receive the holy grail is quite common. If you want an excellent rod to fish with listen to what they are saying.Many buy a rod only to say "I own a so and so". Bob it is not strange, and is the norm for a few builders.

Been there, done that, eventually got the rod, quickly got rid of it. But that's all water under the bridge now. It's like a restaurant that I get a bad meal at; I often give them a chance to correct the mistake, will even go back one more time. After that, I vote with my wallet and go elsewhere. I like AJs rods. There is usually only a limited amount of damage that can be done by dull or stupid people. For creating a truly monumental disaster, you need people with high IQs.

First of all, just to get this out of the way, I'll respect the wishes of banjo and the forum in general and say I won't name names, either here or privately. I didn't start this as a p#@%sing contest or a bitch session, I'm just asking what you would do if in a similar situation, and I'm somewhat surprised at the number who've been through the same thing. Sad comment on the state of the trade methinks... To answer bobbeegees question, for one maker(the 3-1/2 yr. wait) his normal turnaround was around two years, but the order was placed for two rods by a mutual friend and the builder offered to put us to the front of his list if we would pay full price because of their friendship. The other order was placed in late summer, the builder didn't have much of a backlog and promised my rod would be started after the Christmas holidays at the latest. No special consideration asked or given, that was his scheduling based on orders in hand. I may possibly have some legal recourse but there were no written contracts, just a handshake with one and a confirmation phone call(to my friend) with the other. And a couple of checks that cleared the bank. I could probably bring it to a small-claims court but whether it would be worth the time and aggravation I'm not sure. Suing people isn't really my style, siccing the Law on them even less so. But both alternatives are something I'll consider. Basically, I have to agree with AJ that I've been bent over and not kissed afterwards, but I'll keep after them for a while longer, I just have the feeling this is going to be written off as another lesson at "Hard Knocks U"... But I've learned my lesson real good and won't go there again. So thanks again to all who chimed in. I haven't been on the board since shortly after Clark gave it over to banjo, good to know it's still here and full of good info! End with a "call to action" that specifies exactly what you expect from this point forward and when you expect to receive the rods. Send the letter certified, return receipt requested. I am with you about suing and using the legal system to solve problems, but sometimes a well written letter will get results. If you decide to file a complaint, at least you will have some kind of paper trail to give to an attorney. Scott

Your predicament has sadly, if my email box can be trusted, become more commonplace than we would like to admit. I would do exactly what Scott advised with the following proviso. I would send the letter(s) certified mail, with a hard "get back to me" date specified in the note. As in "if I do not get a response from you by xxx I will...." This way you have documented that they received the letter (certified) and also alerted them that there is a rapidly shrinking window of time to fix this problem amicably. -- Dr. Todd

Posts: 842 11/11/2009 13:57	when i was a newly married 23 yr old i bought a brand new 1983 toyota 4x4 . it was my first purchase of this size and i was as proud of it as could be. one day i stoped at a market to get something and when i came out some guy was mad at the world and spun out of the gravel parking lot , leaving me with about 50 dings and scratches along the side of my pickup.I made a mental note of the licence # and called the police. they had empathy but told me it was a civil matter. i decided to sue the fella in small claims court and won since he didnt show up.well, i got a judement. turns out that fella didnt have work or a pot to piss in and refused to accept responsibility for his action.I learned that day that there is little hope of getting justice . i have had no use for courts or police since.I take my lumps as they come and try to move on and not loose any sleep.

If I lost a large sum of cash you better believe I would try everything in my power to get it back even if it seemed like a waist of time, hell you waited 3 to 4 years already what's two weeks for a certified letter? After all you work hard for what you have, a lesson learned I don't think applies when it comes to a 1000+ purchase. If you bought a T.V. for $2000, brought it home and it didn't work, would you keep it and say, I'm not going to shop there anymore. I wish I had the cash do that, oh well, but what about the next guy, who falls victim, shoot you never know, if you pursue this maybe this maker will wake up and get his act together so someone else won't fall prey. You can't name, names so the cycle continues when is it going to stop and who is going to be posting this topic again in the future? I think if we have a chance to take action we should, not only do we protect ourselves, we protect next in the future, if not we are just talk radio!

Most of the time the person is nowhere near you so you cannot go kick the snot out of them and all the e-mails and letters are a waste. I understand the possible legal issue with names. The person (member here) I am dealing with even posted rods for sale here and said they were to pay his debt to me.Thank you to an administrator for deleting his remark but kept the rods for sale. He asked double what the rods were worth and then said to me, well I tried to get the money.

There are some high end makers that will not take a deposit, Mario Wojnicki and Bob Summers come to mind. I believe they do this so as not to be bothered. You'll get the rod when it's done and if you don't , no big deal , it didn't cost you anything. If they make the rod and the buyer bonks, they can easily sell it on the open market. Posts: 2369 11/11/2009 17:28	That's exatly what Bob Summers has always told me, does not want to be bothered and if I move or Ilose interest, or he hangs it up, no one is out anything. Others take a few hundred dollars to make sure the person ordering is serious, and that does not bother me, particularly for anything with lots of options. I feel lucky in that I have never been stuck over the years from a new rodbuilders. The worst that ever happened to me was long delay (almost 3 years instead of one). I did have a relative newbie west coast rodbuilder quote me an over 4k price for a custom rod (and wanted 1/2 down) - this was after telling me he had not built that many rods (he never would tell me how many). But, he certainly has been talked up on this forum at times, and elsewhere. Maybe just shills, seen that before, but the one rod of his I have seen seemed outstanding to me. Buyer beware. Can you at least mention the geographical regions/towns these makers are from? A PM would be most appreciated!
